1. Wie zijn wij?

Databl is een datingapp van Databl, ingeschreven bij de Kamer van Koophandel onder nummer [KVK-NUMMER], gevestigd aan [ADRES] ("wij" of "Databl"). Deze voorwaarden gelden voor iedereen die de app gebruikt. Door een account te maken ga je ermee akkoord. Hoe we met je gegevens omgaan, staat in ons privacybeleid.

2. Je account

• Je bent 18 jaar of ouder.
• Je hebt maar één account, en dat is van jou alleen.
• Wat je invult klopt, en de foto's zijn van jezelf.
• Je houdt je wachtwoord geheim. Gebruikt iemand anders je account, mail ons dan.
• Je kunt je account altijd zelf verwijderen.

3. Hoe ga je met anderen om?

Databl moet een fijne en veilige plek zijn. Het is niet toegestaan om:

• anderen te intimideren, te bedreigen, te beledigen of te discrimineren;
• seksueel getinte berichten of foto's te sturen naar iemand die daar niet om vroeg;
• je voor te doen als iemand anders of een nepprofiel te maken;
• geld te vragen, iets te verkopen, reclame te maken of mensen naar andere diensten te lokken;
• persoonlijke gegevens of foto's van anderen te delen zonder hun toestemming;
• iets te doen wat in strijd is met de wet. Seksueel misbruik of uitbuiting van minderjarigen melden we altijd bij de politie (zie Veiligheid).

Zie je iemand die zich niet aan deze regels houdt? Gebruik in de chat "Melden en blokkeren". We bekijken elke melding. Bij een overtreding kunnen we een waarschuwing geven, een account tijdelijk of definitief blokkeren en geplande blind dates annuleren. Word je om die reden geblokkeerd, dan krijg je je betaling voor een blind date niet terug; je date krijgt wel alles terug.

4. Matchen en de matchscore

Databl berekent een matchscore op basis van je profiel, je voorkeuren en, als je daar toestemming voor geeft, een AI-analyse van je gesprekken. De score is een inschatting en geen belofte. We garanderen niet dat je matches krijgt of dat een match of date klikt.

5. Blind dates

Hoe het werkt

• Je geeft aan wanneer je kunt en wat je leuk vindt. Bij Actief en Cultuur & uitjes zie je wat het ter plekke ongeveer kost. Een date ligt altijd minstens 48 uur in de toekomst.
• Vinden we iemand die bij je past, dan krijg je een melding met datum, tijd en activiteit. Jullie hebben dan allebei 24 uur om te betalen. Betaalt een van jullie niet op tijd, dan gaat de date niet door en krijgt wie al betaald heeft alles terug.
• De date vindt plaats bij een van onze partnerlocaties. Waar precies, zie je zodra jullie allebei hebben betaald.

Wat het kost

• Een blind date kost € 9,95 per persoon, inclusief btw. Je betaalt in de app via Stripe.
• Daarvoor regelen wij de match, het moment en de reservering. Biedt de partnerlocatie een eerste drankje aan, dan staat dat in de app.
• Andere drankjes, eten en de activiteit zelf betaal je ter plekke aan de partnerlocatie.

Een blind date is een dienst op een vaste datum en tijd. Daarom geldt de wettelijke bedenktijd van 14 dagen niet; de regels hierboven komen daarvoor in de plaats.

Niet komen opdagen

Kom je niet zonder af te zeggen, dan krijg je je geld niet terug en kun je tijdelijk geen blind dates plannen: de eerste keer 7 dagen, de tweede keer 30 dagen. De derde keer kun je geen blind dates meer plannen.

Veilig daten

Je ontmoet iemand die je nog niet kent. Een blind date is altijd op een openbare plek. Laat iemand weten waar je bent, regel je eigen vervoer en ga weg als je je niet prettig voelt. Gebeurt er iets wat niet in orde is, meld het ons; bij een strafbaar feit ook de politie.

6. Databl Plus

• Plus is een abonnement met extra functies. De functies en prijzen staan in de app.
• Je sluit Plus af via de App Store of Google Play; daarvoor gelden ook de voorwaarden van Apple of Google.
• Je kunt Plus eerst 7 dagen gratis proberen. Zeg je niet op, dan gaat het abonnement daarna in.
• Het abonnement wordt automatisch verlengd met dezelfde periode. Opzeggen kan altijd, uiterlijk 24 uur voor het einde van de periode, in je App Store- of Google Play-account. De app of je account verwijderen stopt het abonnement niet.
• Voor terugbetaling van een abonnement gelden de regels van Apple of Google.

7. Partnerlocaties

Onze partnerlocaties zijn zelfstandige bedrijven en verantwoordelijk voor hun eigen dienstverlening, zoals het eten, de drankjes en de activiteit. Klachten daarover meld je het beste direct bij de partnerlocatie. Laat het ons ook weten, dan kunnen wij de samenwerking verbeteren.

8. Wat je in de app zet

Je foto's, teksten en berichten blijven van jou. Je geeft ons toestemming om ze te gebruiken voor zover dat nodig is om Databl te laten werken, bijvoorbeeld om je profiel aan anderen te tonen. Die toestemming eindigt als je de inhoud of je account verwijdert. Je zet niets in de app waar je de rechten niet voor hebt. De app, de naam Databl, het logo en de matchscore zijn van ons.

9. Aansprakelijkheid

• We doen ons best om Databl goed en veilig te laten werken, maar kunnen niet beloven dat de app altijd zonder fouten of onderbrekingen werkt.
• We controleren niet wie iedereen is. Je bent zelf verantwoordelijk voor je contact met andere gebruikers, online en tijdens een date.
• Zijn wij toch aansprakelijk, dan is dat beperkt tot het bedrag dat je in de 12 maanden daarvoor aan ons hebt betaald. Dit geldt niet als we de schade met opzet of door grove nalatigheid hebben veroorzaakt.

10. Stoppen

Je kunt altijd stoppen door je account te verwijderen, in de app of via deze pagina. Wij kunnen je account blokkeren of verwijderen als je deze voorwaarden overtreedt, of als we met Databl stoppen. In dat laatste geval laten we het je ruim van tevoren weten en betalen we geplande blind dates terug.

11. Wijzigingen

We kunnen deze voorwaarden aanpassen. Belangrijke wijzigingen laten we je minstens 30 dagen van tevoren weten in de app. Ben je het er niet mee eens, dan kun je je account verwijderen.

12. Klachten en geschillen

Heb je een klacht? Mail naar support@databl.app; we reageren binnen 14 dagen. Komen we er samen niet uit, dan kun je het voorleggen aan de bevoegde rechter in Nederland. Op deze voorwaarden is Nederlands recht van toepassing.

1. Who are we?

Databl is a dating app by Databl, registered with the Dutch Chamber of Commerce under number [KVK NUMBER], located at [ADDRESS] ("we" or "Databl"). These terms apply to everyone who uses the app. By creating an account you accept them. How we handle your data is described in our privacy policy.

2. Your account

• You are 18 or older.
• You have only one account, and it's yours alone.
• What you fill in is true, and the photos are of you.
• You keep your password secret. If someone else uses your account, e-mail us.
• You can always delete your account yourself.

3. How you treat others

Databl should be a pleasant and safe place. You may not:

• harass, threaten, insult or discriminate against others;
• send sexual messages or photos to someone who didn't ask for them;
• pretend to be someone else or create a fake profile;
• ask for money, sell anything, advertise or lure people to other services;
• share other people's personal details or photos without their consent;
• break the law. We always report child sexual abuse or exploitation to the police (see Safety).

See someone breaking these rules? Use "Report and block" in the chat. We review every report. For a violation we can give a warning, block an account temporarily or permanently and cancel planned blind dates. If you're blocked for that reason, you don't get your blind date payment back; your date does get everything back.

4. Matching and the match score

Databl calculates a match score based on your profile, your preferences and, if you agree, an AI analysis of your conversations. The score is an estimate, not a promise. We don't guarantee that you'll get matches or that a match or date clicks.

5. Blind dates

How it works

• You tell us when you're free and what you enjoy. For Active and Culture & outings you see roughly what it costs on the spot. A date is always at least 48 hours ahead.
• When we find someone who suits you, you get a notification with the date, time and activity. You both then have 24 hours to pay. If one of you doesn't pay in time, the date is off and whoever already paid gets everything back.
• The date takes place at one of our partner venues. You see exactly where once you've both paid.

What it costs

• A blind date costs € 9.95 per person, including VAT. You pay in the app through Stripe.
• For that we arrange the match, the moment and the booking. If the partner venue offers a first drink, the app says so.
• You pay for other drinks, food and the activity itself on the spot at the partner venue.

A blind date is a service on a fixed date and time, so the statutory 14-day withdrawal period doesn't apply; the rules above replace it.

Not showing up

If you don't come without cancelling, you don't get your money back and you can't plan blind dates for a while: 7 days the first time, 30 days the second time. After the third time you can no longer plan blind dates.

Dating safely

You're meeting someone you don't know yet. A blind date is always in a public place. Tell someone where you are, arrange your own transport and leave if you don't feel comfortable. If something isn't right, report it to us; if it's a crime, to the police too.

6. Databl Plus

• Plus is a subscription with extra features. The features and prices are shown in the app.
• You take out Plus through the App Store or Google Play; Apple's or Google's terms apply as well.
• You can try Plus free for 7 days first. If you don't cancel, the subscription starts afterwards.
• The subscription renews automatically for the same period. You can cancel at any time, at the latest 24 hours before the end of the period, in your App Store or Google Play account. Deleting the app or your account doesn't stop the subscription.
• Apple's or Google's rules apply to subscription refunds.

7. Partner venues

Our partner venues are independent businesses and responsible for their own services, such as the food, drinks and the activity. It's best to report complaints about those directly to the venue. Let us know too, so we can improve the partnership.

8. What you post in the app

Your photos, texts and messages remain yours. You allow us to use them as far as needed to run Databl, for example to show your profile to others. That permission ends when you delete the content or your account. You don't post anything you don't have the rights to. The app, the name Databl, the logo and the match score are ours.

9. Liability

• We do our best to keep Databl working well and safely, but can't promise the app will always work without errors or interruptions.
• We don't verify who everyone is. You are responsible for your contact with other users, online and on a date.
• If we are liable after all, our liability is limited to the amount you paid us in the 12 months before. This doesn't apply if we caused the damage intentionally or through gross negligence.

10. Ending

You can stop at any time by deleting your account, in the app or via this page. We can block or delete your account if you break these terms, or if we stop Databl. In that case we'll let you know well in advance and refund planned blind dates.

11. Changes

We may change these terms. We'll tell you about important changes in the app at least 30 days in advance. If you don't agree, you can delete your account.

12. Complaints and disputes

Have a complaint? E-mail support@databl.app; we respond within 14 days. If we can't resolve it together, you can take it to the competent court in the Netherlands. Dutch law applies to these terms.
